Definitions
"Images" means all images and related informational materials in any medium furnished by IDS , including related text, captions, or information.
"The Service" means the IDS Service.
"Suppliers" means picture agencies making their Images available on the Service.
Governing Law
This agreement is governed by the laws of England and Wales whose courts are the courts of exclusive jurisdiction. We reserve the right to change these Terms without notice and will alert you to amendments of these Terms via a notice on the website.
IDS
This Service is owned and operated by IDS Ltd. All of the content featured or displayed on this Service, including, but not limited to, text, photographs, images, and software, is owned by IDS and its Suppliers. With the exception of images submitted by Suppliers, any intellectual property in the remaining content of the page displayed by the Service belongs to IDS. All elements of IDS’s websites are protected by trademark, copyright, and other laws relating to intellectual property rights. No portion or element of this website or its Content may be copied and this website, its Content and all related rights shall remain the exclusive property of IDS and its Suppliers. "IDS ", "IDS" and the IDS logo, are trademarks of IDS Ltd or its related companies.
Using IDS
You may use IDS to search for Images for commercial or editorial use. IDS provides watermarked high quality downloads for picture layout purposes, and hi-res downloads for usage. Agencies and photographers supplying pictures are responsible for assigning Rights to you for usage of the Images, for all clearances and releases involved in your usage of the Images, and for invoicing you for a usage fee.
In addition, IDS reserves the right to in future exclude certain agencies, certain territories, or certain users from this system and to incorporate into IDS a pay-per-download system, known as the Download Model, based on the fee structure agreed with certain agencies. Separate terms and conditions associated with the Download Model will be introduced if and when appropriate.
Your registration details must be true and correct. You agree to notify us immediately of any changes which are relevant to your registration by emailing info@ids.com. IDS Ltd ( IDS ) reserves the right to deny access to any element of the Service at its discretion.
You agree to indemnify IDS Ltd and its related companies against any losses, expenses, costs or damages howsoever incurred by any or all of them as a result of your breach of the Terms of this Agreement or your unauthorised use of the Content and related rights.
Disclaimer
Content contained on the IDS Service is not controlled by IDS Ltd and we are not responsible for any loss suffered by you in relation to your use of the Service or Images obtained thereby. Except as required by applicable law, neither IDS nor its directors, employees, Suppliers, or other representatives will be liable for damages of any kind arising out of your use of, your inability to use, or the performance of this website or the Content.
Privacy
We do not share any information you provide to us, including your email, mail addresses, or financial information, with any companies outside IDS Ltd, its related companies and necessary payment processors. From time to time we may notify you of special promotions, new products or services, or other information that may interest you.
